CONSULTING ON HOUSING OWNERSHIP OF FOREIGNERS IN VIETNAM

 

According to the provisions of the Housing Law 2014 which allows foreigners and foreign entities to own houses in Vietnam with the following conditions:

I. Who is entitled to owning houses in Vietnam?

  • Foreign organizations and individuals investing in housing construction project in Vietnam;

  • Enterprises with foreign investment, branch or representative offices of foreign enterprises, foreign investment funds and foreign bank branches operating in Vietnam;

  • Foreign citizens are allowed to enter Vietnam.

II. Form on housing ownership by foreigners

  • Investment in housing construction project in Vietnam;

  • Purchasing, leasing, offering or inheritance of commercial housing includes apartments and individual houses in the investment projects of housing construction, except for areas to ensure defense and security in accordance with regulations of the Government.

III Dossiers needed by individuals and foreign organizations to own houses in Vietnam

  • For foreign individuals: passport, permit entry into Vietnam;

  • For foreign institutions: investment certificates or documents relating to the permitted activities in Vietnam.

IV. Procedures for foreign individuals to own houses in Vietnam

Step 1: Sign contract in sales and purchase, offering, renting, leasing .... houses, apartments.

Step 2: Apply for dossiers of purchasing / offering ... houses to the authorized state agency; 

Step 3: Receive the notification on implementing the financial obligations to the tax authorities and district State Treasury (for the district), Provincial State Treasury to carry out such financial obligations.

Step 4: Submit receipts with fulfilling the financial obligations and receive appointments.

Step 5: Get results upon the appointment.
