GETTING WORK PERMIT IN VIETNAM

Foreigners who want to work legally in Vietnam must be granted a work permit. Enterprises that want to use foreign employees should be responsible for applying the work permits to foreign employees. From April 01, 2016, the procedures in applying work permits to foreigners have a certain number of changes are as follows:

I. The following foreigners must obtain a work permit:

  1. Implementing the labor contract;

  2. Seconded internal enterprise;

  3. Implementing contracts or agreements on economic, trade, financial, banking, insurance, science and technology, culture, sports, education, vocational training and health;

  4. Providing services under the contract;

  5. Offering of services; 

  6. Working for non-governmental organizations abroad, international organizations in Vietnam are permitted to operate under the provisions of the law of Vietnam;

  7. The person responsible for the establishment of commercial presence;

  8. Managers, executives, professionals, technical workers;

II. The procedure of applying for work permit

1. Register demand for labor recruitment of foreign employees to the provincial People's Committee

  • The dossier in registration of recruitment with the provincial People's Committee consists of:

  • Official registration of recruitment needs upon the form;

  • The letter of recommendation / authorization letter.

  • Place in submission: Department of Labor - Invalids and Social Affairs or the Industrial Zone Management Board, Export processing zones Authority.

  • Time of settlement: 15-20 working days;

2. Apply for a work permit at the Department of Labor - Invalids and Social Affairs or management boards of industrial parks and export processing Authority of the province

For the dossier in application for new work permits: 

  • Judicial records issued overseas or in Vietnam;

  • Copy of the university degree or higher education degree;

  • Certificate of experience over 05 years in management positions corresponding to working in Vietnam;

  • Health Certificate issued under the provisions of the Vietnam Ministry of Health; 

  • 02 color photos with size 4cm x 6cm,

  • 01 certified copy of passport;

  • Note: The papers issued in the foreign country must be authenticated copies thereof, within 06 months from the date copies thereof, or from the date of issuance and must be legalized at the consular offices of Vietnam and notary translation in Vietnamese.

For the dossier in application for work permits due to expiry including: 

  • A copy of business registration Certificate or Certificate of operation;

  • Old work permit;

  • Health Certificates issued abroad. In case of foreigners residing in Vietnam, the health certificate issued in accordance with the Vietnam Ministry of Health 

  • 02 color photos (size 4cm x 6cm, white background, bareheaded, taking the area, clear face and ears, without glasses, taken within 06 months)

  • Official letter approval of the use of foreign employees issued by the Municipal People's Committee.

- Number of files: 02 sets;

- Place in charge: Department of Labor - Invalids and Social Affairs or the Industrial Zone Management Board, Export processing zones Authority where Enterprise (The employers) is located.

- Time for settlement:

  • For the dossier in application for new work: 07-10 working days;
  • For re-issuing work permits: 03-05 working days.
